OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing or struck by hazards when working underneath partially lifted vehicle(s): a) Mechanics Shop, Bay 29 - �(a) On or about December 13, 2020, the employer did not ensure employee(s) secured and properly positioned and lifted vehicles while using a two-post automotive lift. An employee sustained fatal crushing injuries during the use of a Mohawk Resources LTD, Model LMF-12, Two Post Vehicle Lift (�Mohawk Lift�) and improperly lifted the cradle end of a JBT Lektro, Inc., Model 2020 AP8850SDA-AL-100/50, Serial Number A85799-320A, Aircraft Towing Vehicle (�Lektro�) with two of the Mohawk Lift�s swing arms which were not equipped with pads. Among other methods, feasible and acceptable method(s) to correct this hazard include, � Within 30 days of signing the ISA, Envoy will develop a Job Hazard Analysis regarding working underneath vehicle lifts. Envoy will provide a copy of the JHA to OSHA. � Within 75 days of signing the ISA, Envoy will develop a work rule prohibiting employees from (1) using two post vehicle lifts to lift Lektros; (2) lifting one end or side of any vehicle; and (3) removing the adapter pads from the swing arms before lifting a vehicle. The work rule will also require employees to place the vehicle�s center of gravity between the two posts and the swing arms below the manufacturer�s recommended lifting points. Envoy will provide a copy of the JHA to OSHA. � Within 75 days of signing the ISA, Envoy will train all Ground Service Technicians at Chicago O�Hare Airport on the JHA and work rule and provide evidence of the same. Envoy will provide evidence of the training to OSHA.�

29 CFR 1910.178(l)(6): The employer did not maintain certification that each operator has been trained and evaluated as required by this paragraph (l), containing information including the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation: a) Mechanics Shop- On or about March 25, 2021, the employer did not maintain records to certify that all employees were trained and evaluated on each powered industrial vehicle they operate, including the Toyota sit down forklift. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
