29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a.) Complete Liquidators: On or about December 15, 2020 employees were exposed to struck-by hazards when employees were required to operate forklifts and stand-up lifts without first completing a training and evaluation program to determine competency. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

Complete Liquidators, 2207 Radcliffe Street Dock B Bristol, PA: On or about December 8, 2020, an employee was hospitalized for injuries sustained from a accident involving a forklift and stand-up lift. The employer failed to report the hospitalization within 24 hours as the report was received on December 10, 2020. No abatement certification or documentation is required.
