29 CFR 1926.501(b)(2)(ii): Each employee on a walking/working surface 6 feet (1.8 m) or more above a lower level where leading edges are under construction, but who is not engaged in the leading edge work, shall be protected from falling by a guardrail system, safety net system, or personal fall arrest system. If a guardrail system is chosen to provide the fall protection, and a controlled access zone has already been established for leading edge work, the control line may be used in lieu of a guardrail along the edge that parallels the leading edge. a) 263 Walmart Drive, Camden, DE - On or about 12/11/2020, the employer failed to ensure that each employee was not protected from falling as required. A total of 8 employees were working on the roof approximately 18 feet above the roadway where the controlled access zone was not in place to prevent employees from falling from the roofs edge of the rear/back side of the building.

A total of 8 employees were working on the roof approximately 18 feet above concrete grade with more than 184 skylights installed in the roof. The employer did not install any type of guardrail system or require the wear of a personal fall arrest system to prevent employees from falling through the skylights
