29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) ENC Roofing LLC, at a jobsite located at 7363 Whimbrel Lane, Lot 1230, Sunbury, Ohio 40374: On and/or preceding December 15, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to personal protective equipment program and a fall protection program for employees conducting roofing work.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) ENC Roofing LLC, at a jobsite located at 7363 Whimbrel Lane, Lot 1230, Sunbury, Ohio 40374: On and/or preceding December 15, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Roofers were using pneumatic nail guns to secure shingles to the roof. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) ENC Roofing LLC, at a jobsite located at 7363 Whimbrel Lane, Lot 1230, Sunbury, Ohio 40374: On and/or preceding December 15, 2020, the employer did not ensure employees were protected from falls while engaged in residential roofing activities. An employee was installing roofing materials to a new construction two-story house without any means of fall protection, thereby being exposed to a fall hazard of up to 11 feet, 4 inches.

29 CFR  1926.502(d)(15):Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached.  a) ENC Roofing LLC, at a jobsite located at 7363 Whimbrel Lane, Lot 1230, Sunbury, Ohio 40374: On and/or preceding December 15, 2020, the employer did not ensure employees used anchorages capable of supporting 5000 pounds while engaged in residential construction activities. An employee was roofing with a vertical lifeline tied around wall studs, thereby exposed to fall hazards of up to 11 feet 4 inches.  b) ENC Roofing LLC, at a jobsite located at 7363 Whimbrel Lane, Lot 1230, Sunbury, Ohio 40374: On and/or preceding December 15, 2020, the employer did not ensure employees used anchorages capable of supporting 5000 pounds while engaged in residential construction activities. An employee was roofing with an anchor that was nailed to roof sheathing, thereby exposed to fall hazards of up to 20 feet.  c) ENC Roofing LLC, at a jobsite located at 7363 Whimbrel Lane, Lot 1230, Sunbury, Ohio 40374: On and/or preceding December 15, 2020, the employer did not ensure employees used anchorages capable of supporting 5000 pounds while engaged in residential construction activities. An employee was roofing with a rope tied directly around the top of the trusses at the truss nail plate, thereby exposed to fall hazards of up to 20 feet.

29 CFR 1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall:  29 CFR  1926.502(d)(16)(iii): be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level.  a) ENC Roofing LLC, at a jobsite located at 7363 Whimbrel Lane, Lot 1230, Sunbury, Ohio 40374: On and/or preceding December 15, 2020, the employer did not ensure personal fall protection systems were rigged so that an employee could not fall greater than 6 feet. An employee was installing roofing materials to a new construction two-story house while his vertical lifeline was fully extended, thereby being exposed to a fall hazard of greater than 6 feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) ENC Roofing LLC, at a jobsite located at 7363 Whimbrel Lane, Lot 1230, Sunbury, Ohio 40374: On and/or preceding December 15, 2020, the employer did not ensure employees were trained on the recognition of fall hazards or the correct procedures required to be followed to minimize the fall hazards. Employees, without fall protection training, were conducting roofing activities while working on a two story new construction single family house, thereby exposed to fall hazards of up to 20 feet.
