Plum Creek Parkway - Lexington, Nebraska 68850 On or about November 18, 2020, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i)-(ix). The employer required employees to wear respirators during COVID-19 testing of suspected positive patients.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Community Care Health Network, LLC dba Matrix Medical Network located at 1500 S. Plum Creek Parkway - Lexington, Nebraska 68850 The employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees to wear respirators while testing suspected positive COVID-19 patients in the following instances: A) On or about May 26 through November 18, 2020, employees mandated to wear KN95 respirators were not provided medical evaluations. B) On or about November 19, 2020, employees mandated to wear and fit test N95 respirators were not medically cleared by a licensed health care professional until December 15, 2020 and December 22, 2020.
