On December 16, 2020, and times prior thereto, the employer used a modified lifting hook attachment (set-up) on a powered industrial truck and did not change the maintenance instruction plates, tags or decals on forklift #18, model #DP150, serial # DP10595 Industrial Truck 673Y as required, potentially exposing employees to struck-by hazards.

29 CFR  1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered.  On December 16, 2020 and times prior thereto, the employer used a modified lifting hook attachment (set-up) not listed on the powered industrial truck nameplate to lift heavy concrete material, exposing employees to struck-by hazards.

29 CFR  1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set.    In the crushing yard, an employee  (powered industrial truck operator) left a powered industrial truck unattended with forks elevated and concrete material attached, exposing an employee to crush-by hazards.

On or about December 16, 2020, and times prior thereto, the employer did not ensure forklift number 18 was taken out of service until repairs were made by an authorized person. The forklift had damaged including, but not limited to tires with large chunks/gouges and broken taillights/missing bulb, exposing employees to struck-by hazards.
