29 CFR 1910.134(e)(2)(i): The employer did not identify a physician or other licensed health care professional (PLHCP) to perform medical evaluations using a medical questionnaire or an initial medical examination that obtained the same information as the medical questionnaire:  a) Naamans Creek Country Manor located at 1194 Naamans Creek Road Road Garnet Valley, PA 19060:  On or about  December 9, 2020, and continuing thereafter the employer did not ensure that a physician or other licensed health care professional (PLHCP) performed medical evaluations using a medical questionnaire before employees were fit tested or required to use respirator in the workplace. Registered Nurses conducted medical evaluations and employees were fit tested and required to wear respirators while providing care to suspected and confirmed positive COVID-19 residents.

29 CFR l 910.134(e)(3)(i): The employer did not provide a follow-up medical examination for each employee who gave a positive response to any questions among questions 1 through 8 in Section 2, Part A of Appendix C before the employee was fit tested or required to use the respirator in the workplace:   a) Naamans Creek Country Manor located at 1194 Naamans Creek Road Road Garnet Valley, PA 19060:  On or about November 20, 2020  and continuing thereafter, the employer did not provide a follow-up medical examination prior to fit testing and required use of N95 respirators when the employee's initial medical evaluation demonstrated the need for a follow-up medical examination. The employees wear N95 respirators while providing direct care to suspected and confirmed COVID-19 positive residents.
