29 CFR  1926.1153(c)(1):Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  On or about December 22, 2020, the employer did not ensure that employees engaged in cutting concrete using a hand saw and jackhammer were fully and properly implementing the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  Employees were using a saw that was not equipped with an integrated water delivery system that continuously fed water to the blade and a jackhammer not equipped with a water delivery system that supplied a continuous stream or spray of water at the point of impact to remove concrete by the doors of an oil change facility.
