29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  At jobsite located at 7960 Caribou Pl. Bel Air KS, the employer did not ensure that appropriate permission from the manufacturer was obtained by the user prior to using an attachment on the Skytrack Telehandler, and did not ensure that markings for the capacity, operation and maintenance were changed accordingly. This condition exposes employees to struck-by and crushing hazards.

29 CFR  1926.451(c)(2)(v):The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:  At jobsite located at 7960 Caribou Pl. Bel Air KS, employees engaged in residential framing activities were exposed fall hazards and crushing hazards while employees stood on the basket in that the scaffold platform was not attached to the forks or forklift.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  At jobsite located at 7960 Caribou Pl. Bel Air KS, employees engaged in residential framing activities were exposed to fall hazards of approximately 12 feet from the roof to the ground in that fall protection was not utilized.  JCS Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1237756, Citation number 1, Item number 1 and was affirmed as a Final order on 08.11.2017, with respect to a workplace located at 2700 E 11th Ave Hutchinson, KS 67501.
