29 CFR  1926.102(a)(1):Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  New townhome construction located on Lots #176-#181 Catamaran Court, Alpharetta, GA 30005: On or about 12/22/2020, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees using these tools at over 120 PSI engaged in framing and sheathing activities.

29 CFR  1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.   New townhome construction located on Lots #176-#181 Catamaran Court, Alpharetta, GA 30005, Front side scaffold on Lot #178: On or about 12/22/2020, the employer exposed employee to a fall hazard of 16-feet, 5-inches to the lower ground level, in that the 2 2x10s used as a scaffold platform were spaced greater than 1-inch apart  creating a fall hazard as the employee was engaged in framing activities.

29 CFR  1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection.    (a) New townhome construction located on Lots #176-#181 Catamaran Court, Alpharetta, GA 30005, Front side roof: On or about 12/22/2020, the employer exposed an employee to falls of 21-feet to the lower ground level, in that the personal fall protection system used was not used with all the components needed for a complete personal fall arrest system. The life-line and lack of proper anchor compromised the system as the components used were not engineered or approved before use.   (b) New townhome construction located on Lots #176-#181 Catamaran Court, Alpharetta, GA 30005, Front side roof: On or about 12/22/2020, the employer exposed an employee to falls of 16-feet, 5-inches to the lower level, in that the life-line was not used with a proper anchor as it was tied to itself which is not recommended by the manufacturer. Employee using the fall protection in this manner was exposed to falls.

29 CFR  1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:   (a) New townhome construction located on Lots #176-#181 Catamaran Court, Alpharetta, GA 30005, Lot #178 first floor stairwell: On or about 12/22/2020, the employer exposed employees to falls of 11-feet to the lower level, in that a ladder or stairway was not provided between the first and second levels of the structure. Employees used a wall brace and a 6-foot step-ladder to access each level.
