OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to struck by injuries from utilizing damaged racking systems: (a) Throughout frozen and dry food warehouses; On or about December 28, 2020, employees were exposed to potential struck by hazards because damaged upright columns (risers) and beams on a metal racking systems were not isolated from use, unloaded, repaired, and/or replaced once damage was identified on racking systems in areas including, but not limited to; Y-37 to Y-39, P-61-21 to P-61-22, Q-45-22, J-66-11 to J-66-12, J-64-11 to J-62-12, J-62-11 to J-60-12, J-41-12, and J-34-11.
