29 CFR  1910.178(a)(6): The employer did not ensure that all nameplates or markings were maintained in a legible condition:   Employees engaged in forklift operation and material handling activities in the shop, the feed mill area, the surrounding areas of the grain elevator, the chemical shed and the dried fertilizer area were exposed to struck-by hazards in that the following markings for the Nissan forklift were not in place and legible: a) The nameplate, which identifies the load capacity, model number and serial number, was not legible. b) The two control levers were not legibly marked.  29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   Employees engaged in machining activities at the shop were exposed to struck-by and amputation hazards in that machine guarding was not provided and utilized. The rotating drill chuck for the Chicago Power Tools Drill Press DP-558-2, Chuck 5/8" Serial #66871 was not guarded.  29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR  1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:   Employees engaged in grinding activities at the shop were exposed to struck-by hazards in that the distance from the abrasive wheel to the adjustable tongue guard was found to be approximately 0.5 inch for the Black and Decker Automotive 6820 Serial #9339 Heavy Duty 3/4 HP 8" Bench Grinder.  29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR 1910.272(k): Receiving pit feed openings in the grain handling facility, such as truck or railcar receiving pits, were not covered by grates which had a maximum opening width of 2 1/2 inches:  Employees engaged in housekeeping and making feed activities at the feed mill by the feed mill drive were exposed to tripping and fall hazards in that the grates were bending causing the openings to measure more than 2.5 inches.  29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR  1910.303(f)(2): Each service, feeder, and branch circuit, at its disconnecting means or overcurrent device, was not legibly marked to indicate its purpose, nor located and arranged so the purpose was evident:  Employees engaged in grain handling activities were exposed to fire and electrical shock hazards in that the disconnecting means, circuit breaker boxes at the following locations were not properly labeled to indicate their intended use for the equipment listed below.  a) Chemical Shed by the front entrance door - Four (4) of the Disconnect D Safety Switch boxes not label. b) Inside the Chemical Shed by the Control Room for the Dried Fertilizer area - Two (2) of the D Safety Switch boxes not labeled. c) Inside the Chemical Shed by the Control Room for the Dried Fertilizer area - One (1) Circuit Breaker box not label for all the fuse slots.  29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR  1910.1200(f)(6)(i): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v):   Employees engaged in housekeeping, and grain handling activities were exposed to health hazards in that the unknown containers were not labeled, marked or tagged with the identity of the chemical. a) Outside door of the Man Lift Room by the railroad - 1 container with no label. b) The Shop - 1 bottle/container with no label.  29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
