29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Big Horn Plastering, Inc. at 12230 E Colfax Ave in Aurora, CO 80011: On 11/4/2020, the employer did not maintain a safety program which provided for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them). Employees were directed to erect scaffolding directly adjacent to an open HVAC shaft that was not covered. The employer did not inspect the work areas to determine the presence of floor openings or other fall hazards prior to initiation of work. This condition exposed employees to a fall hazard of 13' 9" which resulted in a neck injury of one employee.
