The employer did not provide NIOSH-certified respirators to IMCU employees including, but not limited to Registered Nurses required to care for suspected and confirmed positive COVID-19 patients. The employer provided and required employees to wear respirators labeled KN95. The respirators were not NIOSH-certified. Violation occurred on or about 2/18/2021 and thereafter.

The employer did not provide an annual fit test to all employees required to wear N-95 respirators. The employer provided and required employees including, but not limited to ICU Registered Nurses to wear N95 respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 patients. Violation occurred on or about 1/28/2021, and thereafter.
