29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck: A.) ACV Environmental Services, Inc. dba ACV Enviro, 8347 Mercer Street, Pulaski, PA 16143, on or about January 4, 2021 and times prior thereto: An employee was operating a Hyster H300HD2 (S/N: L019E02051U) powered industrial truck. The employee did not have training and evaluation on the operations of the Hyster powered industrial truck. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR 1910.178(m)(8): There was not sufficient headroom under overhead installations, lights, pipes, sprinkler system, etc: A.) ACV Environmental Services, Inc. dba ACV Enviro, 8347 Mercer Street, Pulaski, PA 16143, on or about January 4, 2021 and times prior thereto: An employee was operating a Hyster H300HD2 (S/N: L019E02051U) powered industrial truck. As the employee was exiting the east driveway of the facility to enter onto Mercer Street, the mast of the forklift contacted the overhead powerlines. There was not sufficient clearance for the mast of the powered industrial truck to pass under the powerlines. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
