1926.503(c)  The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section:Note:  Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previ 29 CFR  1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems or a combination of warning line system and safety monitoring system.   On or about January 5, 2021, employees engaged in roofing activities on a low sloped roof were not protected from a fall, exposing employees to a fall of approximately 14 feet.

1910.178(l)(6)  The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l): 29 CFR  1910.178(l)(4):Located at this establishment, an evaluation of each powered industrial truck operator's performance had not been conducted at least once every three years, such as, but not limited to, employees operating the rough terrain fork truck without current training.  On or about January 5, 2021, an employee was allowed to operate a powered industrial truck prior to being evaluated within three years, exposing the employee to the hazards associated with operating a powered industrial truck.
