29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On or about December 16, 2020, during the removal and installation of roofing material on a two story residential townhome located at 100 and 102 Pebble Court, Berea, Ohio, the employer did not ensure employees working from the roof were protected from a fall of approximately 20 feet (2 stories), by utilizing a guardrail system, safety net system and/or personal fall arrest system.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   On or about December 16, 2020, during the removal and installation of roofing material on a two story residential townhome located at 100 and 102 Pebble Court, Berea, Ohio, the employer did not provide a training program to each employee in the recognition fall hazards and the procedures to minimize fall hazards for the employees working from a roof approximately 20 feet (2 stories) above the ground.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  On or about December 16, 2020, the employer did not report within 24 hours the in-patient hospitalization injury of an employee who fell approximately 20 feet from a residential roof, while performing roofing work, at a worksite located at 100 and 102 Pebble Court, Berea, Ohio.  OSHA was not notified of the in-patient hospitalization injury until on or about December 21, 2020, by the Berea, Ohio Police Department.
