29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:   a- Lot 549, 2 Westmont Drive, Medford NJ: On or about 10/20/2020, Lezinho Sousa dba Lifetime Contractor Corporation, Inc. had not initiated a program to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition.  As such his employees were exposed to fall, struck by, electrical, and other hazards at the worksites.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a- Lot 549 - 2 Westmont Drive, Medford NJ: Employees were exposed to struck by hazards when working beneath and near framing and sheathing operations without using protective helmets. Condition observed on or about 10/20/2020.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Condition observed on or about 10/20/2020.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a - Lot 549, 2 Westmont Drive, Medford NJ:  Employees were exposed to fall hazards, up to and in excess of 8 feet to the floor below, when performing roof truss installation while working and walking on the top plates of a residential structure's outer and inner walls without the use of fall protection.    b - Lot 549, 2 Westmont Drive, Medford NJ:  Employees were exposed to fall hazards, up to and in excess of 13 feet to the floor below, when accessing the second story of a residential structure by entering onto the floor and exiting the floor by standing on the exterior of an unguarded window opening when coming to and from the top step of an extension ladder.  At the time of the exposure these employees were not utilizing fall protection.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a- Lot 549, 2 Westmont Drive, Medford NJ: Employees were exposed to fall hazards, up to and in excess of 8 feet to the ground surface below, when performing framing activities at unprotected edges while on the top plates of exterior and interior walls, accessing and egressing the second floor of a structure through a window opening using an extension ladder, etc. without the use of fall protection.  At the time of these exposures the worksite company employees had not received fall hazard recognition and minimization training from the company.  Condition noted on or about 10/20/2020.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
