29 CFR 1926.200(b)(1):A danger sign was not used where an immediate hazard exists: a) Gallery 102 - While on the second floor, employees entered and were removing material from an Electro-Elsa material hoist, model number M20S, serial number 880711, where the loading dock door was not secure in that it was missing a door slide latch, and had a broken or missing door guide, exposing employees to a fall hazard of 28 feet and 11 inches, and a danger sign was not posted on or about 09/28/2020. ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.200(h)(1): Accident prevention tags shall be used as a temporary means of warning employees of an existing hazard, such as defective tools, equipment, etc. They shall not be used in place of, or as a substitute for, accident prevention signs. a) Gallery 102 - While on the second floor, employees entered and were removing material from an Electro-Elsa material hoist, model number M20S, serial number 880711, that was not tagged as defective or out of service, where the loading dock door was not secure in that it was missing a door slide latch, and had a broken or missing door guide, exposing employees to a fall hazard of 28 feet and 11 inches, on or about 09/28/2020. Or In the Alternative: 29 CFR 1926.20(b)(3): Machinery, tool(s), material(s), or equipment which was not in compliance with the applicable requirement(s) of 29 CFR 1926 was not prohibited, and/or was not either identified as unsafe by tagging, or locking the controls to render them inoperable, or physically removed from its place of operation. a) Gallery 102 - While on the second floor, employees entered and were removing material from an Electro-Elsa material hoist, model number M20S, serial number 880711, that was not tagged as defective or out of service, where the loading dock door was not secure in that it was missing a door slide latch, and had a broken or missing door guide, exposing employees to a fall hazard of 28 feet and 11 inches, on or about 09/28/2020.
