29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about January 13, 2021, at the west side of the building, the supported scaffold platform was more than 2 feet above the ground and a safe means to access the scaffold was not provided. Employees doing brick work at the 3rd scaffold platform were exposed to falls when accessing scaffold platforms.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity). On or about January 13, 2021, at the building exterior, the following areas of the supported scaffold lacked guardrails and was greater than 10 feet from the ground: a. West end of the supported scaffold, 3rd tier, and b. Middle of the supported scaffold, 3rd tier. Employees performing overhand bricklaying work at the 3rd tier of the supported scaffold, were exposed to falls greater than 10 feet to a lower level.
