29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) Park Ridge Care Center, Ltd. located at 665 Busse Highway, Park Ridge, IL 60068.  On November 12, 2020 and at times thereafter, the employer required employees to wear N95 respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents. The employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix) before requiring the use of N95 respiratory protection during patient care.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Park Ridge Care Center, Ltd. located at 665 Busse Highway, Park Ridge, IL 60068.  On November 12, 2020 and at times thereafter, the employer required employees to wear N95 respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents. 29 CFR  1904.40(a): The employer did not provide an authorized government representative the records within the four business hours.  a) Park Ridge Care Center, Ltd. located at 665 Busse Highway, Park Ridge, IL 60068.  On January 12, 2021, upon request, the employer did not provide the OSHA Form 300, Log of Work-Related Injuries and Illnesses, for calendar year 2020 and the Form 300-A, Summary of Work-Related Injuries and Illnesses, and Form 301, Injury and Illness Report, for calendar years 2019 and 2020, within four business hours. The OSHA 300 Logs, 301s and 300-A were not provided until April 23, 2021.

29 CFR  1904.41(a)(2): Annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. If your establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form.  a) Park Ridge Care Center, Ltd. located at 665 Busse Highway, Park Ridge, IL 60068.  On or about March 3, 2021, the employer did not electronically submit information from OSHA 300A Summary of Work-Related Injuries and Illnesses for calendar year 2020 by March 2, 2021.  The establishment employed 45 employees and is classified 623110 during calendar year 2020.  No abatement certification or documentation is required for this item
