29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about May 4, 2020, and times prior thereto at a construction site, employees were installing/laying out roof trusses on unprotected sides and edges without fall protection exposing the employees to fall hazards of approximately 72 feet to the ground below.  Mr. Cesar Viera Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1473968, citation number 1, item number 1 and was affirmed as a final order on August 27, 2020, with respect to a workplace located at Building # 6, 900 Cinema Dr., Hudson Oaks, Texas.

29 CFR  1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee.  On or about May 4, 2020, and times prior thereto,  the employer did not provide an effective training program and adequate hazard recognition and avoidance training for employees exposed to fall hazards, and most recently employees were exposed to fall hazards of approximately 72 feet to the ground below.
