29 CFR  OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees to struck-by and caught between hazards:  a) Facility - On or prior to January 11, 2021, employees were exposed to struck-by and caught between hazards while working on and around a 1970 Michigan Pay Loader (Model: 55A, S/N: 416A336) (White handles) that did not have a functioning back-up alarm, had a seat in poor condition with no seat belt, had rusted out and not bolted down top cab part, had brakes that did not work, and hydraulic leaks.  b) Facility - On or prior to January 14, 2021, employees were exposed to struck-by and caught between hazards while working on and around a 1972 Michigan Pay Loader (Model: 55B, S/N: 433B159) (Black Handles) that did not have a functioning back-up alarm, had a seat in poor condition with no seat belt, had brakes that did not work, and hydraulic leaks.  c) Facility - On or prior to January 14, 2021, employees were exposed to struck-by and caught between hazards while working on and around a Komatsu Excavator (Model: PC150-3, S/N: 04300, Year of Manufacture: 1993) that leaks hydraulic fluid and does not have a travel alarm.  d) Facility - On or prior to April 9, 2021, employees were exposed to struck-by and caught between hazards while working on and around a Komatsu Excavator (Model: PC200LC-6L, S/N: A81306, Year of Manufacture: 1995) that did not have a functioning travel alarm.
