29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems. On or about January 13, 2021, and at times prior thereto, a competent person did not make daily inspections of the excavation to ensure protective systems were adequate and other conditions did not exist that could result in possible cave-ins. The site had an excavation with a total depth of more than five(5) feet and this exposed the employees to cave-in hazards.

29 CFR 1926.652(c)(3)(iii): A copy of the tabulated data used to construct the protective system used at the jobsite, identifying the Professional Engineer who approved the data, was not made available upon request. On or about January 13, 2021, at the job site, the employer did not ensure that the tabulated data, for a protective system that was installed in a trench, was made available. The protective system was used in the excavation where earth material was excavated more than two feet below the shield and this exposed the employees to a cave-in hazard.

29 CFR 1926.652(g)(2): Excavations of earth material to a level greater than 2 feet (.61 m) below the bottom of a shield was permitted. On or about January 13, 2021, at the job site, the employer did not ensure that there was no more than two(2) feet of excavated material below the protective shield for the trench that employees were working in. This exposed the employees to a cave-in hazard.
