29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazard. On or about January 5, 2021: Employees performing maintenance duties are exposed to corrosive chemicals such as but not limited to sulfuric acid (93%). On 1/5/21, an employee received chemical burns to his back, neck and right side of his torso when the pump near the valve he was observing failed/cracked from the pressure build-up of acid mixed with water (exothermic reaction) in the line near the pump. The employer did not properly assess the work hazard.

29 CFR 1910.147(c)(4)(ii)(D): Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures. On or about January 5, 2021: Employees performing maintenance duties are exposed to hazards such as but not limited to sulfuric acid (93%). The employer used water to test the line prior to introducing the acid into the line. The pressure of the exothermic reaction of sulfuric acid and residual water caused the pump to fail spraying 93% sulfuric acid onto the maintenance employee, resulting in chemical burns to his neck and torso.
