29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: (a) Hall-Irwin Corporation at 1013 N 25th Ave, Greeley, CO 80631: On and before January 14, 2021, the controlling employer did not ensure that daily inspections of an excavation with Type B soil that measured approximately 140 feet in length, 16 feet in width, and had one nearly-vertical side wall which was 7.5 feet in height from its base, was protected from cave-in. Subcontractor employees were checking GPS coordinates and other tasks inside the excavation the morning of and prior to the cave-in. This condition exposed subcontractor employees to struck-by and cave-in hazards. (b) Hall-Irwin Corporation at 1013 N 25th Ave, Greeley, CO 80631: On and before January 14, 2021, the controlling employer did not ensure that daily inspections of an excavation that measured approximately 140 feet in length, 16 feet in width, and had one nearly-vertical side wall which was 7.5 feet in height from its base, was protected from cave-in. Subcontractor employees were operating a BMR 8500 compactor inside the excavation and a front-end loader Komatsu WA250 on top of the excavation. Two subcontractors from separate companies were working next to the unprotected cut-off wall, which was Type B soil, when it caved-in. One subcontractor was not struck by the cave-in and did not sustain injuries; however, the other subcontractor was caught-in the cave-in and subsequently died. This condition exposed subcontractor employees to struck-by and cave-in hazards. Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
