29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposing employees to struck by hazards.  a) Worksite, 6 Blue Bird Lane, Huntington, New York 11743:   On January 18, 2021, an employee was exposed to struck-by hazards from a secondary tree limb that was used as an anchor and rigging point. The employer did not have a qualified arborist to recognize and prevent safety hazards associated with tree trimming, tree climbing and rigging operations while working aloft in a tree.   Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR  1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard.  The employer did not ensure employees are trained in the requirements of this paragraph on or before May 17, 2017.    a) Worksite, 6 Blue Bird Lane, Huntington, New York 11743:   On or about  January 18, 2021, an employee of Rodneys Landscaping LLC was exposed to fall hazards from cutting a tree branch approximately 40-feet above the ground without utilizing proper means of fall protection. The employee did not receive fall protection training.  Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.1903.19.

29 CFR  1910.135(a)(1):The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  a) Worksite, 6 Blue Bird Lane, Huntington, New York 11743:   On or about  January 18, 2021, an employee of Rodneys Landscaping LLC was exposed to struck-by hazards from a broken tree branch that was used as an anchor and rigging point. The employee was not provided with head protection when performing tree trimming work.    Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1910.140(c)(13): Anchorages were not capable of supporting at least 5000 pounds (22.2 kN) for each employee attached or designed, installed, and used under the supervision of a qualified person, as part of a complete personal fall protection system that maintains a safety factor of at least two.   a) Worksite, 6 Blue Bird Lane, Huntington, New York 11743:   On or about  January 18, 2021, an employee of Rodneys Landscaping LLC was exposed to fall hazards from cutting a tree branch approximately 40-feet above the ground without utilizing proper means of fall protection.  The employee secured the fall protection system to a branch that was not capable of supporting the weight and was not installed under the supervision of a competent person.   Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.1903.19.
