OSH ACT of 1970 Section (5)(a)(1)  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  (a) Ice Castles, LLC at 120 Buffalo Street, Dillon, CO 80453: On and before January 19, 2021 the employer did not ensure that each employee on a walking/working surface having an unprotected side or edge which was six feet or more above a lower level was protected from falling by the use of a guardrail system or personal fall arrest system, in that employees constructing an ice structure were not utilizing a fall protection system when traversing across the archway's walking-working surface with an unprotected side. This condition exposed employees to a fall hazard of approximately 12 to 15 feet.  Feasible and acceptable abatement methods include, but are not limited to:  a. Ensure employees work from scaffolding in accordance with 29 CFR 1926.450 Subpart L when erecting guardrails on archways that are 6 feet or more above a lower level.  b. Ensure that employees utilize a personal fall protection system that meets the safety requirements of the International Climbing and Mountaineering Federation (UIAA) and prevents employees from contacting the lower level when traversing across archway walkways that have unprotected sides that are 6 feet or more above a lower level.  c. Ensure that employees utilize a personal fall protection system that meets the safety requirements of the International Climbing and Mountaineering Federation (UIAA) and prevents employees from contacting the lower level when installing guardrails on archway walkways that have unprotected sides that are 6 feet or more above a lower level.
