OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from crushing, struck-by, pinched or caught-in and fall type hazards while using a freight elevator:  (a) Freight elevator and stairwell located in the food service receiving area:  On or about 1/8/2021, employees were exposed to crushing, struck-by, pinched or caught-in and fall type hazards while using the freight elevator that services the school kitchen, where trash is removed from the kitchen area to the upper level.

29 CFR 1910.25(b)(5)(i): The employer did not ensure that when a door or a gate opens directly on a stairway, a platform is provided, and the swing of the door or gate does not reduce the platform's effective usable depth to less than 20 inches (51 cm) for platforms installed before January 17, 2017:  (a) Stairwell adjacent to the service freight elevator serving the school kitchen:  On or about 1/8/21, the employer did not ensure that when the door at the midpoint of the stairwell was opened, a platform of at least 20 inches was available.  The platform was entirely blocked by the opening door, exposing employees to fall hazards from slips and trips while using the stairs to access the freight elevator and outside trash dumpsters.

The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section):  (a) Stairwell adjacent to the service freight elevator serving the school kitchen:  On or about 1/8/21, the employer did not ensure that guardrail systems had top rails that were no higher than 42 inches (plus or minus 3 inches) above the stair treads exposing employees to fall hazards of up to 14 feet while using the stairs to access the freight elevator and outside trash dumpsters:  1) The upper stairwell top rails were 48 inches above the stair treads, 2) The lower stairwell top rails were 33 inches above the stair treads.
