29 CFR 1926.1431(h)(1): A trial lift with the unoccupied personnel platform loaded at least to the anticipated lift weight was not made from ground level, or any other location where employees will enter the platform, to each location at which the platform is to be hoisted and positioned. Where there is more than one location to be reached from a single set-up position, either individual trial lifts for each location, or a single trial lift, in which the platform is moved sequentially to each location, must be performed; the method selected must be the same as the method that will be used to hoist the personnel: (a) Cell phone tower @ 2935 Tower Hill Road, South Kingstown, R.I. 02879: On or about 01/22/21, a trial lift was not performed with the unoccupied personnel basket prior to lifting employees to the working area on the cell tower.

29 CFR 1926.1427(a): The employer did not ensure that each operator is trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section: (a) Cell phone tower @ 2935 Tower Hill Road, South Kingstown, R.I. 02879: On or about 01/22/21, a crane operator on the site, lifting employees with a personnel basket, did not have the proper training, certification and/or licensing required by this section.
