29 CFR OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from a struck by hazard during tree removal operations. On or about January 19, 2021, at the Wooster Cemetery Association located at 983 Madison Ave., Wooster, Ohio 44691 an employee was injured while attempting to fall a tree on the cemetery lot. The tree was approximately 50 feet high, after completing the cut the tree began to fall in an unexpected direction, the employee attempted to flee but was unable to and was struck by the tree. The employer did not provide training to the employee or have a Qualified Arborist on the site during the tree removal process.
