29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in and crushing hazards while using malfunctioning automotive lifts in the service department:   (a) 670 Automotive Drive, Colorado Springs, CO 80905: On or about January 25, 2021 and at times prior, employees were exposed to caught-in and crushing hazards while operating malfunctioning automotive lifts.. Lifts were not maintained in accordance with manufacturer's standards. The safety latches would not disengage as designed on Rotary Lift SPOA10N50Q (S/N BVP04I0031) when lifting heavy vehicles to the highest lift point. Two employees were manually disengaging the safety latches, one using the lift controls and the other using the manual release system. On January 16, 2021, an employee suffered a severe injury to the finger when operating a malfunctioning lift which had not been removed from service.   Abatement note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).  Among other methods, feasible and acceptable abatement methods to correct the hazard include but are not limited to: Remove malfunctioning lifts from service in a timely manner. Establish an inspection and preventative maintenance program to ensure that lifts are inspected and maintained in accordance with manufacturer's instructions and the ANSI/ALI ALOIM-2008 -Standard for Automotive Lifts - Safety Requirements for Operation, Inspection and Maintenance.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   (a) 670 Automotive Drive, Colorado Springs CO 80905: On or about January 16, 2021, and at times prior, the Rotary Lift SPOA10N50Q (S/N BVP04I0031) ("lift 13") was missing the safety cover on the manual release mechanism.  The safety cover was available on the mechanic's workstation.  An employee was injured while using the manual release mechanism, resulting severe injury to the finger.  The safety cover was replaced prior to the inspection on January 25, 2021.  (b) 670 Automotive Drive, Colorado Springs CO 80905: On or about January 25, 2021, and at times prior, the Challenger Lift 39000  (S/N Unknown) ("lift 3")was missing the safety covers on the mechanical release lever.  The safety cover was available on the mechanic's workstation and replaced during inspection.  (c) 670 Automotive Drive, Colorado Springs CO 80905: On or about January 25, 2021, and at times prior, the Challenger Lift 39000, (S/N 3-918870) ("lift 7") was missing the safety covers on the mechanical release lever.  The safety cover was not present at the mechanic's workstation.  A replacement cover was obtained from a lift which had been removed from service.  (d) 670 Automotive Drive, Colorado Springs CO 80905: On or about January 25, 2021, and at times prior, the Challenger lift 39000 (S/N 3914377) ("lift 9") was missing the safety covers on the mechanical release lever.  The safety cover was available on the mechanic's workstation and replaced during inspection.  (c) 670 Automotive Drive, Colorado Springs CO 80905: On or about January 25, 2021, and at times prior, the Rotary (unknown model, unknown S/N) ("lift 16") was missing the safety covers on the mechanical release lever.  The safety cover was available on the mechanic's workstation and replaced during inspection.  Abatement note: all violations were abated during inspection.
