The employer required employees to wear respirators such as but not limited to N95 3M (1860/8210), HDX (H950s/H950), and Zhong Yi Mask (ZYB-11) filtering facepiece respirators while providing care to suspected and confirmed positive COVID-19 residents.

29 CFR 1910.134(e)(2)(i):The employer did not identify a physician or other licensed health care professional (PLHCP) to perform medical evaluations using a medical questionnaire or an initial medical examination that obtained the same information as the medical questionnaire:  (a) Roosevelt Rehabilitation & Healthcare Center located at 7800 Bustleton Avenue Philadelphia, PA:  On or about January 25, 2021 the employer did not ensure that a physician or other licensed health care professional (PLHCP) performed medical evaluations using a medical questionnaire before employees were fit tested or required to use respirator in the workplace. Registered Nurses conducted medical evaluations and employees were fit tested and required to wear respirators such as but not limited to 3M (1860/8210), HDX (H950s/H950), and Zhong Yi Mask (ZYB-11) while providing care to suspected and confirmed positive COVID-19 residents.

The employees wear N95 respirators while providing direct care to suspected and confirmed COVID-19 positive residents.

29 CFR 1910.134(f)(2): Employees using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator, and whenever a different respirator facepiece (size, style, model or make) was used:   Roosevelt Rehabilitation & Healthcare Center located at 7800 Bustleton Avenue, Philadelphia, PA:  (a) On or about January 25, 2021, the employer did not ensure that employees required to wear filtering facepiece respirators were fit tested prior to required use. The employer required employees to wear respirators such as N95 filtering facepiece 3M 1860/8210, HDX H950s/H950, and Zhong Yi Mask ZYB-11 respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.  (b) On or about January 25, 2021, the employer did not ensure that employees required to use respirators were fit tested with the same make, model, and size whenever new respirator was used at the site. The employer required employees to wear N95 filtering facepiece respirators such as 3M 1860/8210, HDX H950s/H950, and Zhong Yi Mask ZYB-11, to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.
