29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a) The Greens at Rapho Park, Worksite, Trench - on or about January 25, 2021, a worker was conducting testing operations with a trench, in excess of  five feet below grade, without utilizing a fully adequate protective system.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  a) The Greens at Rapho Park, Worksite - on or about January 25, 2021, an employee was working within an incompletely protected trench with receiving the necessary excavation safety training.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
