OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that; employees were exposed to struck-by, crushing, and caught-in-between hazards: a. On or about January 26, 2021, at the above addressed work site, the employer did not ensure operators of the 4 x 4 Genie aerial lift, two employees performing tree trimming operations did not follow the manufacturer's recommendation regarding the safe operation of the equipment, thereby, exposing the workers to struck-by, crushing, and / or caught-in-between hazards, in the event the machine was to tip over.

29 CFR 1910.67(c)(2)(v):(v) A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, shall be worn and attached to the boom or basket when working from an aerial lift: a. On or about January 26, 2021, in a 4 x 4 Genie aerial lift, two employees performing tree trimming operations were not protected from a fall hazard, in that; there was no personal fall arrest systems being used.
