29 CFR  1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided.  On the north side of the construction site, the employer did not provide an extension ladder where employees could access and egress the residential building second level, exposing them to potential fall hazards.

29 CFR  1926.304(d):When the tool was withdrawn from the work, the lower guard did not automatically and instantly return to the covering position.  On the north side of the construction site, an employee operating a Makita skill saw with lower guard wedged in the up position while cutting framing material exposing him to cuts and scrape hazards.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.   On the north side of the construction site, employees engaged in framing work without fall protection were expose to unprotected fall hazards of approximately 9 feet to the ground below.  Refugio Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1240318, citation number 1, item number 1 and was affirmed as a final order on August 29, 2017, with respect to a workplace located at 842 Cauble Dr., Fate, Texas 75132.

29 CFR  1926.503(a)(2)(i): 29 CFR 1926.501(a)(2)(I):  The employer shall ensure that each employee has been trained , as necessary, by a competent person, in the nature of fall hazards in the work area.   On January 26, 2021, the employer did not ensure the employees working from a height of 9 feet without fall protection was train to recognized and correct hazards associated with the framing work.
