29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) On or about January 28, 2021, and at times prior thereto, the employer did not effectively instruct and document training to employees on the hazards of operating heavy equipment, including but not be limited to bulldozer and similar equipment and similar equipment, including struck by and crush by hazards to which employees were exposed.

29 CFR 1926.600(a)(3)(i): Bulldozer and scraper blades, end-loader buckets, dump bodies, and similar equipment were not either fully lowered or blocked when being repaired or when not in use. All controls were not in a neutral position, with the motors stopped and brakes set, unless work being performed requires otherwise.  a) On or about January 28, 2021, the employer did not effectively ensure that a  bulldozer's blades and rippers were fully lowered or blocked, with all controls were in a neutral position, the motors stopped and brakes set when not in use and when the operator left the equipment's was not at the equipment's controls, exposing employees to struck by and crush by hazards.
