29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about January 25, 2021 at 7742 US HWY 98, Navarre, FL, Building #1: The employer exposed employees to hazards associated with falls of approximately 26 feet from the roof to the ground due to employees either not using fall protection or not connected properly to prevent a fall of less than 6 feet. Mario Tobar was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 15022589, citation number 1, item number 1a and was affirmed as a final order on December 4, 2020, with respect to a workplace located at Cotton Creek Estates, buildings 5, 7 and pool house, Gulf Shores, Alabama 36542.
