29 CFR 1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: El Dorado Care and Rehab located at 900 Country Club Lane, El Dorado, Kansas: On or about February 1, 2021, the employer did not develop and implement an adequate written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required employees to wear respirators throughout their shifts while exposed to suspected or confirmed positive COVID-19 patients. Specifically the program did not address worksite specific procedures for respirator use related to: 1) 1910.134(c)(1)(ii)-Medical evaluations of employees required to use respirators 2) 1910.134(c)(1)(iii)-Fit testing procedures for tight-fitting respirators

29 CFR 1910.134(d)(1)(ii):The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification: El Dorado Care and Rehab located at 900 Country Club Lane, El Dorado, Kansas: On or about February 1, 2021, the employer did not provide NIOSH-certified respirators to employees who were required to care for suspected and confirmed positive COVID-19 patients. The employer provided and required employees to wear respirators labeled "[KN95]." However, the KN-94 manufactured by Shenzhen Zhongcheng Medical Techonlogy Co., Ltd. did not contain certification markings indicating they were certified under an equivalent international standard
