29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from struck by hazards: On or about February 1, 2021, the employer failed to ensure that the safety latch on the Coffing 1 ton jib crane being used daily in the facility, was repaired or replaced prior to the crane being placed into use. The safety latch on the hook was missing. Employees are exposed to hazards, such as but not limited to, struck by and caught in between hazards.

29 CFR 1910.22(a)(3): 29 CFR 1910.22(a)(3): The employer did not ensure that walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice. On or about February 1, 2021, the employer failed to ensure that the walking and working surfaces of the main facility where the shear machine is located, is clear of debris that can cause slip, trip and fall hazards. Employees are having to climb over various materials that are blocking safe access to the shear machine. Employees are exposed to slip, trip and fall hazards.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): On or about February 1, 2021, the employer failed to ensure that the powered industrial vehicles, to include but not limited to the Green Clark 915-0005-7164 FB, was inspected prior to use to ensure the vehicles are safe for employees to operate. The Green Clark powered industrial vehicles has faulty brakes where employees who operate it must place the vehicle into the neutral position in order to get it to stop. Employees are exposed to hazards, such as but not limited to being struck by.
