29 CFR  1926.102(a)(1): 29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  On or about February 2, 2021, and at times prior thereto, employees were exposed to a struck-by flying projectile hazard while using pneumatic nail guns without eye protection.

29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper-level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    On or about February 2, 2021, and at times prior thereto, employees were exposed to a fall hazard while using an extension ladder that was not extended three feet from the roof.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     On or about  February 2, 2021, and at times prior thereto,  employees were exposed to a fall hazard greater than 6 feet while installing roof shingles on a residential construction site without fall protection.  Sergio Bautista was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.501(b)(13), which was contained in OSHA inspection number 1375036, citation number 1, item number 1, and was affirmed as a final order on March 1, 2019, with respect to a workplace located at 802 Kingston Dr. Cedar Pak, TX 78613.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   On or about  February 2, 2021, and at times prior thereto, employees were exposed to fall hazards greater than six feet when installing shingles for a residential construction site, without fall hazard recognition.  Sergio Bautista was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.503(a)(1), which was contained in OSHA inspection number 1375036, citation number 1, item number 2, and was affirmed as a final order on  March 1, 2019, with respect to a workplace located at 802 Kingston Dr. Cedar Pak, TX 78613.
