29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking /working surface, were not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. (a) Power Design, Inc. at 1160 E. 18th Ave, Denver, CO 80218: On and before January 21, 2021 the exposing employer did not ensure that each employee working on, at, above, or near wall openings where the outside bottom edge of the wall opening was 6 feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system, in that employees installing metal conduit detached one side of the top guard rail covering the opening to the exhaust ventilation shaft in Level B1of an apartment building under construction while not utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 12-15 feet.
