29 CFR 1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with this part. (a) Andy's Excavating & Sewer, on or about February 3rd, 2021, at the location of 5447 Bonniebrooke Dr., Sylvania, OH, 43560: Employees were working in and/or around excavations without the benefit of accident prevention programs to identify and mitigate the associated hazards. The employer created an unprotected excavation 8 feet, 5 inches deep for employees to enter in order to replace a sewer line, exposing the employees to potential cave-in hazards.

29 CFR 1926.651(k)(1):An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) Andy's Excavating & Sewer, on or about February 3rd, 2021, at the location of 5447 Bonniebrooke Dr., Sylvania, OH, 43560: The employer failed to ensure a competent person assessed an 8 feet, 5 inches deep excavation prior to employees working in or around the opened excavation. An employee operating at the excavation's edge was not benefited with an inspection by a competent person to ensure structural integrity, appropriate soil classification and adequate protective systems prior to the start of work. The employer had no plan to ensure adequate cave-in protection for employees that were to enter the excavation, exposing them to potential engulfment hazards in the event of a collapse.
