29 CFR 1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part: On or about January 28, 2021 and prior to that time for waterline trenching / excavation work located adjacent to the facility Water Treatment Facility the employer had not followed their safety program(s) specific to trenching and excavation control method procedures which address collapsed trench trapped worker(s) requiring rescue, in that prior to the initiation of opening an excavation the company had not establish coordination with qualified local emergency trench rescue agencies or contacted companies who were qualified to perform trench rescue operations prior to the need to make emergency contact exposing employee(s) to secondary side wall collapse hazards and delays in trench rescue nor establish procedures concerning prohibiting mechanical digging around collapsed trench trapped worker(s) exposing employee(s) to potential hazardous contact between mechanical digging excavator components.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about January 28, 2021 located adjacent to the Water Treat Facility, an employee was working outside the trench box in a trench/excavation in excess of 6 foot 5 inches deep which was not adequately protected against cave-ins, in that the walls of the trench/excavation outside the Speed Shore Trench Shield (trench box) were not properly sloped, shored or otherwise adequately protected against collapse.
