29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   a) 136 Thorn St, Clarksburg: On or about January 9th, 2021 and times prior employees were required to use respiratory protection, such as a disposable N-95, after a client had tested positive for COVID.  The employer did not develop or maintain a written respiratory protection program prior to requiring the use of respirators.

29 CFR  1904.4(a):The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent.    a) 136 Thorn St, Clarksburg: On or about January 10, 2020, an employee tested positive for COVID-19 after being exposed through a client who tested positive for the virus.  The work related injury was not recorded on the employer's OSHA 300 log.   b) 136 Thorn St, Clarksburg: On or about January 14, 2020, an employee tested positive for COVID-19 after being exposed through a client who tested positive for the virus.  The work related injury was not recorded on the employer's OSHA 300 log.  c) 136 Thorn St, Clarksburg; On or about January 15, 2020, an employee tested positive for COVID-19 after being exposed through a client who tested positive for the virus.  The work related injury was not recorded on the employer's OSHA 300 log.  d) 136 Thorn St, Clarkburg: On or about April 28th, 2020, the employer learned that an employee was diagnosed as positive for COVID-19 and died after being exposed through a client who tested positive for the virus.  The work related death was not recorded on the employer's OSHA 300 log after being notified of the COVID injury.
