29 CFR 1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a. 29 CFR 1910.178(p)(1):If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a. On or about February 4, 2021, and at times prior, powered industrial equipment was found to be in need of repair and was not taken out of service until the equipment was restored to a safe operating condition. The most recently occurred in the Upper Cooler area of the warehouse, a Crown powered industrial pallet jack (Serial Number: GA218273, Model Number: PE4000-80, Equipment Number: 86) was in operation that had been found to be in need of repair. The forklift was found to have an abrasion on the power cables exposing internal wires but was not taken out of service. The Sygma Network, Inc was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1204456, citation number 1, item number 1 and was affirmed as a final order on March 27, 2017 with respect to a workplace located at 510 International Park, Newman, GA 30265.

29 CFR 1910.37(a)(3):Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level. a. On or about February 4, 2021, located on the cooler dock of the warehouse near bay door 1, there were pallets and debris which partially obstructed the exit route, thereby exposing employees to the hazards associated with an emergency situation. b. On or about February 4, 2021, located on the cooler dock of the warehouse between bay doors 8 and 9, there were pallets and debris which partially obstructed the exit route, thereby exposing employees to the hazards associated with an emergency situation.
