29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   On or about February 1, 2021, on the north side of the jobsite; employees rode in a homemade basket to access the roof and were not protected by the use of a personal fall arrest systems or a guardrail system.

29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about February 2, 2021, on the north and west side of the structure, employee(s) were installing a new roof at a height of 6 feet or more above a lower level without appropriate means of fall protection.
