29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems. On or about February 04, 2021 and at times prior thereto, the employer did not ensure that employees and sub-contractor employees were in use of fall protection when working near hoist areas. This exposed the employees to a fall hazard greater than six (6) feet to the ground below: 1. Opening on second floor without adequate fall protection in place. 2. Opening on third floor without adequate fall protection in place.

29 CFR 1926.501(b)(7)(ii): Each employee at the edge of a well, pit, shaft, or similar excavation 6 feet (1.8 m) or more in depth was not protected from falling by guardrail systems, fences, barricades, or covers: On or about February 04, 2021 and at times prior thereto, the employer did not ensure that employees and employees of a subcontractor were in use of fall protection system when working near the elevator shaft. The guardrail was inadequate and exposed employees to a fall greater than six (6) feet to the ground below.
