29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical a) Omnipure Water Treatment Area: On or about February 3, 2021 an unlabeled chemical container was stored inside a flammable locker without product name and hazard warning labels. Employee used the chemical for assigned work tasks, the unknown chemical was determined to be pipe dope, it was removed and disposed.

29 CFR 1910.95(d)(1)(ii):Unless the employer can show that area sampling produces equivalent exposure monitoring, the employer did not use representative personal sampling to comply with the monitoring requirements of 29 CFR 1910.95(d): a) Platform A: On or about February 3, 2021 employees working in production areas were exposed to high noise levels identified in a noise survey performed by the previous platform owner, XTO Energy Incorporated. A noise hazard assessment by use of representative personal sampling methods was not determined for noise exposure levels as comparison to OSHA's TWA Action Level of 85 dBA for 8 hours and did not estimate for a 12-hour extended work shift.
