OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while working in a Mobile Elevated Work Platform (MEWP) that was overloaded beyond the manufacturer's load limit of 500 pounds:  2927 Hunter Road, east side of main barn, on or about 2-5-21:  Three employees simultaneously accessed a roof using a mobile elevated work platform (MEWP) without wearing and connecting a safety harness or body belt, exposing the employees to a fall hazard of 10 feet or more; and each employee carried a 50-pound bag of salt, overloading the lift basket beyond the manufacturer's load limit of 500 pounds.  ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM  Among other methods, one feasible and acceptable method of abatement to correct the hazard is:  Employers shall comply with American National Standards Institute (ANSI)/Scaffold and Access Industry Association (SAIA) A92.22-2020, Fall Protection, paragraph 6.8.1.2, stating:  All Group B Mobile Elevated Work Platform (MEWP) operators and occupants shall use personal fall arrest systems (PFAS) at all times.  Employers shall comply with American National Standards Institute (ANSI)/Scaffold and Access Industry Association (SAIA) A92.22-2020, Distribution of Load, paragraph 6.8.8, stating:  Users shall direct, and operators shall comply with the requirements for rated loads and their distribution on the MEWP and any MEWP extensions be in accordance with the manufacturer's requirements.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while on a barn roof removing snow:  2927 Hunter Road, east side of main barn, on or about 2-5-21:  Three employees were removing snow from a metal barn roof, 4:12 pitch, without fall protection or the training necessary for the employees to recognize the hazards associated with falls and their work, exposing employees to a fall hazard of approximately 10 feet to the ground below.  ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM  Among other methods, one feasible and acceptable method of abatement to correct the hazard is:  Employers shall complete a fall hazard assessment on all walking working surfaces in accordance with American National Standards Institute (ANSI) 1264.1 SAFETY REQUIREMENTS FOR WORKPLACE WALKING WORKING SURFACES, paragraph 1.3.3 (Hazard Assessment).  Every exposed edge on a floor, roof, platform, runway or ramp; equal or greater than 4 feet in elevation from which persons can pass and fall to the lower level shall be protected in such a manner to prevent a person from passing through the opening and falling in accordance with American National Standards Institute (ANSI) 1264.1 SAFETY REQUIREMENTS FOR WORKPLACE WALKING WORKING SURFACES, paragraph 5 (Fall Protection).  Employers shall train employees and other users in the safe use and maintenance of elevated walking working surfaces, guardrail /handrail systems and stairways in accordance with American National Standards Institute (ANSI) 1264.1 SAFETY REQUIREMENTS FOR WORKPLACE WALKING WORKING SURFACES, paragraph 9.3 (Employee Training).  In accordance with OSHA DIRECTORATE of TECHNICAL SUPPORT and EMERGENCY MANAGEMENT (DTSEM) 12/2017 HA-3513 entitled "Preventing Falls During Snow Removal".  -Using snow removal methods that do not involve workers going on roofs, when and where possible (i.e., utilize snow rakes).  -Evaluating loads exerted on a roof or structure (i.e., total weight of snow, workers and equipment used, etc.) compared to the load limit of the roofs.  -Requiring that workers use fall protection equipment.  -Ensuring that workers use ladders and aerial lifts safely.

29 CFR  1904.39(a)(2):  The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a)2927 Hunter Road, Scipio Center, NY,  on or about 2-5-21:  One employee was injured after falling through a roof while removing snow, was hospitalized, and the employer failed to report the hospitalization within 24 hours.
